Acceptance of general conditions of sale
Purchases made on minicarstore.it are safe and guaranteed and can be made in different ways:

The contract between Minicarstore and the Customer must be concluded with the acceptance, even partial, of the order by Minicars. This acceptance is considered tacit, if not otherwise communicated with any manner to the Customer. By placing an order in the various modalities, the Customer declares to have read all the indications given to him during the purchase procedure, and to fully accept the general conditions and payment below.

If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his or her professional activity), once the online purchase procedure is completed, it will print or save electronic copy and, in any case, retain these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance sales.

Any right of the Customer shall be excluded for damages or compensation, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or things, caused by the non-acceptance, even partial, of an order.
How to purchase

Customer can buy only the products present in the electronic catalog of minicarstore.it at the time of the forwarding of the order and viewable online at the address (URL) https://www.minicarstore.it/en/, as described in the relevant information sheets. It is understood that the description of a product can not be perfectly representative of its characteristics but differ by color, size, accessories present in the figure. All information to support the purchase is intended as a simple generic information material, not referring to the real characteristics of a single product.

The correct reception of the order is confirmed by Minicars by e-mail, sent to the email address communicated by the Customer. This confirmation message will report Date and Time of order execution and a 'New Customer Order', to be used in any further communication with Minicars. The message reproduces all the data entered by the Customer who undertakes to verify its correctness and to communicate promptly any corrections, according to the methods described in this document.

In the case of failure to accept the order, Minicars guarantees prompt communication to the Customer.
Payment methods

Purchases via Paypal
In case of purchase of the goods with PayPal payment mode, at the end of the online transaction, PayPal will immediately charge the amount relating to the purchase made.-
In case of order cancellation, either by the Customer or in the event of failure to accept the Customer by the Customer Minicars, at the same time as the cancellation, the amount relating to the cancelled goods will be credited to the Paypal account of the customer. The credit time on the payment tool selected within the Paypal account depends exclusively on PayPal and the banking system. Once the amount is re-accredited on the Paypal account, in no case Minicarstore may be held responsible for any damages, direct or indirect, caused by delays in actual credit dependent on Paypal or the banking system.

Minicarstore reserves the right to request supplementary information (e.g. fixed telephone number) to determine the actual ownership of the PayPal account. In the absence of the required documentation, Minicarstore reserves the right not to accept the order.

At no time of the purchase process Minicarstore is able to know the information about the buyer's credit card or other methods chosen within the PayPal wallet. In no event can Minicarstore be held responsible for any fraudulent and undue use of credit cards by third parties, upon payment of products purchased on https://www.minicarstore.it/en/.

Bank Transfer Advance
The payment form Bonifico Anticipato cannot be used on all items in the catalogue. Any restrictions are clearly highlighted within the shopping cart. In case of payment via Minicarstore, the order of the Customer will be kept committed until receipt of the proof of the transfer, to be sent to Minicarstore (via fax or e-mail) within and no more than 3 working days from the date of acceptance of the order. The sending of the order will only occur at the actual accretion of the sum due on the c/c of Minicarstore that will take place within 7 working days from the date of acceptance of the order. After passing these deadlines, the order will be deemed automatically canceled.
The cause of the bank transfer must report:- the reference number of the order;
- the date of execution of the order;
- name and surname of the order owner.

Mark
In case of purchase in Mark, an additional contribution will be applied to the total amount, clearly highlighted at the time of the choice of the payment method. Payment shall be made only in the following ways:
- with cash;
- with CIRCOLARE check in order to the courier that will carry out the delivery;
- with CIRCOLARE check in order to the courier that will carry out the delivery;
If the value of the mark exceeds the maximum amount accepted by the courier, Minicarstore may request the excess amount by bank transfer.
Methods and delivery costs

Minicarstore can accept orders only with delivery in Italian territory. The delivery in Livigno and Campione d'Italia is excluded.

For each order placed on https://www.minicarstore.it/en/,Minicarstore emette invoice of the shipped material, by sending it to the parcel sent to the order holder, pursuant to article 14 D.P.R. 445/2000 and DL 52/2004. For the issue of the invoice, the information provided by the Customer shall be authentic upon order. No change in invoice will be possible, after the issue of the same.

The delivery costs shall be borne by Minicarstore, subject to any Contributions of Transport, explicitly highlighted at the time of the execution of the order. The payment of the goods by the Customer will be made using the method chosen at the time of the order. Nothing is extra due to the Customer than the total order.

No liability may be charged to Minicarstore in the event of delay in order evasion or delivery of the order.

Al delivery time of the goods by the courier, the Customer is required to check:
- that the number of packages in delivery corresponds to what is indicated in the early transport document by e-mail;
- that the packaging is intact, undamaged, wet or otherwise altered, even in the closing materials (adhesive tape or metal rods).
Any damage to packaging and/or product or failure to match the number of packages or indications, must be immediately challenged, affixing RESERVE OF CONTROL SCRITTA (SPECIFICING THE MOTIVO OF RESERVE, e.g. "float packaging", "crapped packaging", etc.) on the delivery test of the courier. Once the courier's document is signed, the Customer may not object to any dispute regarding the external characteristics of the delivery.
Any problems related to physical integrity, correspondence or completeness of products received must be reported within 7 days of delivery, in accordance with the arrangements provided for in this document. -
In the case of failure to withdraw within 5 working days of the material present in storage at the warehouses of the courier due to repeated impossibility of delivery to the contact indicated by the Customer at the time of order, the ordered will be returned to the warehouses of Minicarstore.
Right of withdrawal

Pursuant to Article 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Minicarstore a reference of VAT Partition), he is entitled to withdraw from the purchase contract for any reason, without having to provide explanations and without penalty, subject to the following points 17 and 18.

For exercise this right, the customer must send to Minicarstore a notice in this regard, within 10 working days from the date of receipt of the goods. This notice shall be sent by registered letter with reception notice addressed to:

or by telegram or fax always sent within the said period of 10 days and followed by a confirmation by registered letter with reception notice, sent TASSATIVAMENT within 48 hours. Once we have received the aforementioned withdrawal notice, the Minicarstore Service will quickly communicate to the customer the instructions on how to return, assigning a unique code of RMA for the return of the goods, which will be sent to Minicarstore within 10 days of authorization.
The goods must be returned integral, complete with all its parts and in the original packaging (busts and packages), guarded and possibly used according to normal diligence, without any signs of wear or dirt, in compliance with the conditions of the following points. -
The right of withdrawal is subject to the following conditions:
- the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, attached software, etc...);
- the right does not apply to audiovisual products or computer software sealed (including those attached to hardware material), when opened;
- the goods purchased must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc.); to limit damage to the original packaging, we recommend to insert it in a second box, on which to affix the label provided by Minicarstore showing the number of RMA (return authorization code); should be avoided in all cases the application of labels or adhesive tapes directly on the original packaging of the product;
- under the law, the shipping costs relating to the return of the goods are borne by the customer; delivery costs will not be refunded to the customer and any other additional expenses highlighted at the time of the order;
- the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
- in case of damage to the goods during transport, Minicarstore will notify the customer of the event (within 5 working days from receipt of the goods in its warehouses), in order to allow him to protrude promptly complaint against the courier he chooses and obtain the reimbursement of the value of the goods (if insured); in this event, the product will be made available to the customer for his return, at the same time cancelling the request for withdrawal;
-Minicarstore, does not respond in any way to damages or theft/loss of goods returned with uninsured shipments;
- upon arrival in stock, the product will be examined to assess any damage or tampering not resulting from transport. If the original packaging and/or packaging are ruined, Minicarstore. will retain from the refund due to a percentage, however not more than 10% of the same, as a contribution to the recovery costs. -
Without prejudice to recovery costs for damages ascertained to the original packaging,Minicarstore will refund to the customer the entire amount already paid, within 14 days from the return of the goods, by means of procedure of cancellation of the amount charged on the Credit Card or by means of Bank Transfer. In the latter case, the customer will promptly provide the bank details on which to obtain the refund (Cod. ABI - CAB - Current account of the invoice holder).

The right of withdrawal is totally lacking, due to the lack of the essential condition of integrity of the good (confection and/or its content), in cases where Minicarstore mentions:
- the un diligent use of the good that has compromised its integrity, or the use of any consumables;
- the lack of the external packaging and/or the original internal packaging;
- the absence of integral elements of the product (accessories, cables, manuals, parts, ...);
- product damage due to causes other than its transport.
In the event of the cancellation of the right of withdrawal, the goods will remain at the headquarters of Minicarstore at the disposal of the Customer for the withdrawal to your cargo.
Guarantees

All products sold by Minicarstore are covered by the manufacturer's conventional warranty and 24 months warranty for compliance defects, according to Legislative Decree 206/05. To benefit from warranty assistance, the Customer must retain the invoice that will receive via e-mail in PDF or word electronic format.
The exercise of the Warranty may include the request for assistance to the Authorized Service Centres present on the territory and/or follow the methods outlined in the documentation present within the product packaging. -
The manufacturer's conventional warranty is provided according to the methods shown in the documentation present within the product packaging. If, as a result of intervention by an Authorized Service Center, the defect should be not covered by the manufacturer's conventional guarantee, the Customer will be charged with any verification and restoration costs required by the Authorized Assistance, as well as transport costs, if sustained by Minicarstore.

24 months warranty under Legislative Decree 206/05 applies to the product that there is a lack of conformity, as long as the product itself is used correctly, in compliance with its intended use and with the technical documentation attached. This guarantee is reserved to the private consumer (physical person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a reference of VAT. In the event of a lack of conformity, Minicarstore provides, without charge for the Customer, to restore the conformity of the product by repairing/replacement or reducing the price, until the termination of the contract. If, as a result of intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 206/05, the Customer will be charged with any costs of verification and restoration required by the Authorized Assistance, as well as transport costs if sustained by Minicarstore.

Replacements in case of DOA (Dead On Arrival: product not working at delivery) only occur if expressly provided by the manufacturer. The replacement or repair times of the product depend exclusively on the manufacturer's policies.
27 In the event that, for any reason, it is not able to make its customer a product in guarantee (restored or replaced), Minicarstore may proceed at its discretion to return the amount paid taking into account the use of the goods or to its replacement with a product of equal or superior characteristics. -
Minicarstore is not responsible for any delays in carrying out repairs or replacements.

In cases where'application of guarantees the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc.); to limit damage to the original packaging, we recommend inserting it into a second box; labels or adhesive tapes should be avoided in all cases directly on the original packaging of the product.
The Customer will be provided with an authorization number for the return of the product (RMA) which must be indicated outside the packaging, following the information provided directly in the relevant authorization email.
Privacy

Personal data required in the process of forwarding the order are collected and processed in order to satisfy the express requests of the Customer and will not be in any case and in no way given to third parties. Minicarstore, guarantees to its customers compliance with the regulations regarding the processing of personal data, governed by the privacy code referred to in DL 196 of the 30.06.03.

Applicable law

The contract of sale between the Customer and Minicarstore, is concluded in Italy and regulated by the Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his municipality of residence; in all other cases, the territorial competence is exclusively that of the Forum of Caltanissetta.
